"Ralph’s Wines Ltd aims to provide you the consumer with an online shopping facility that is easy to use reliable, quick and secure. Below are our terms and conditions to make your life easier and answer any questions you might have". Ralph Smith In order to buy wine from this website you must do so according to the terms and conditions and by Registering you are agreeing to be bound by them. 1). General. 1.1) These terms and conditions shall apply to all contracts for the sale of goods by Ralph’s Wines Ltd to the consumer. 1.2) Ralph’s Wines Ltd reserves the right to choose not to accept an order for any reason. 1.3) Where mixed cases of wine are offered, Ralph’s Wines Ltd reserves the right to replace certain items with others of similar value at any time. 1.4) Nothing in these terms and conditions shall affect or exclude your statutory rights as a consumer. 1.5) When an order is placed with Ralph’s Wines Ltd, the consumer must be in accordance of the UK licence law and be of at least 18 years of age. If the consumer is buying goods as a gift then the recipient must be at least 18 years old, and be signed for delivery by an adult aged 18 years or over. 2). Prices & Payments. 2.1) All prices are inclusive of duty taxes and are exclusive of VAT and any delivery charges. 2.2) The price of all goods sold through the website is stipulated by Ralph’s Wines Ltd price list at the date of order or as agreed by the concerning parties. 2.3) Payment of the total purchase price, including VAT and delivery (if applicable) must be made in full before the dispatch of the goods. Unless agreed otherwise with Ralph’s Wines. 2.4) Ralph’s Wines Ltd will notify the consumer once the payment has been received by email with a clear receipt. 2.5) There will not be any agreement between Ralph’s Wines Ltd and the consumer, if the consumer is under the age of 18 years at the time of the order, even if the order has already been accepted via the website. 2.6). All balance transfer payments should include the consumers name and invoice number as reference to indentify the receipt of payment. Ralph’s Wines Ltd will not be held liable, if the wrong account details have been entered inaccurately and no payment has been received, the consumer will still be liable to pay for the goods before they are dispatched. 2.7). On payment methods including balance transfer’s and cheque’s, only once the payment has been received and debited into our account will the goods be dispatched, for example if paying by cheque the consumer will be notified once funds have been cleared and when to expect delivery (if applicable). 2.8). Ralph’s Wines Ltd reserve’s the right to change our prices should any changes in the exchange rates, duty taxes or supplier prices change. We will inform all customers of any change via email. 2.9). For all events including weddings payments must be received in full 30 days prior to the event. Failure to do so will result in the loss of your deposit payments. 3). Delivery. 3.1) Delivery of any goods shall be made by Ralph’s Wines Ltd notifying the consumer that the goods are either available for collection at a pre arranged premises or for delivery to such place or as agreed between Ralph’s Wines Ltd and the consumer at the time the order is placed. 3.2) All goods shall be delivered within 28 days of an order being placed wherever possible and the consumer shall make all necessary arrangements to take the delivery of goods whenever they are tendered for delivery. 3.3) Ralph’s Wines Ltd shall endeavour to meet any delivery date agreed by the two parties. In any event time of delivery is not met, Ralph’s Wines Ltd shall not be liable for any loss, costs, damages or expenses incurred by the consumer or any third party arsing directly or indirectly out of any estimated delivery date. 3.4) All goods shall be made up in multiples of six bottles to minimise the risk of breakages during transportation. 3.5) Once the goods have been accepted and signed for by the consumer, responsibility title and risk of the goods passes onto the consumer. 3.6) If in the event some goods may not be in stock at the time an order is placed, Ralph’s Wines Ltd will contact the consumer to advise them of the situation and the consumer shall be entitled to cancel the order and receive a full refund or agree a later delivery. 3.7) Ralph’s Wines Ltd warrants that the goods will correspond at the time of delivery to the description given on the purchase order. 3.8) Ralph’s Wines Ltd does not accept any responsibility for late or non-delivery of goods arising from incorrect delivery information being provided. 3.9) Ralph’s Wines Ltd cannot except responsibility for goods going missing when the goods have been delivered without you present. 3.10) Where a delivery is requested in London’s congestion charge zone between the chargeable hours the consumer shall be liable to an additional fee to cover the cost of the tax. 3.11) The standard delivery charge for 2010 will be free on all purchases with the total net value of £250, anything below this will incur a delivery charge plus VAT. 4). Returns and Cancellations. 4.1) The consumer must inspect the goods immediately upon delivery and shall notify Ralph’s Wines Ltd in writing if the goods are damaged or do not comply with the agreed contract within 7 days. 4.2) Any goods bought or orders made can be cancelled within 7 days of receipt of the goods by informing Ralph’s Wines Ltd in writing. Goods must be returned at the consumers cost and should be adequately insured during the return journey. The consumer shall receive a refund of all monies paid for the goods including delivery charges (if any) within 30 days of cancelling. 4.3) Where a claim of faulty or damaged goods is made then it shall be the responsibility of the consumer to return the goods where the consumer shall be entitled to replacement goods or a full refund (including delivery costs if applicable) if the goods are in fact defective. 5). Sale or Return. 5.1) All sale or return orders must include a minimum of £300 of wine and beer. A maximum of 20% of the original order quantity can be returned. All returned goods must be in re-saleable condition otherwise no credit will be given. For all returns please notify Ralph’s Wines no later than 5 days after the event date agreed. The consumer will be responsible for returning all sale & return goods to Ralph’s Wines. 5.2). In the case of an event cancelation all deposits accepted for goods are non refundable after 7 working days. 6). Security. 6.1) All information including credit & debit card details are entered and received using the latest in secure e-commerce software. Ralph’s Wines Ltd will continue to use new security protocols and software as they become available. 7). Guarantees & Customer Satisfaction. 7.1) In addition to the buyers statutory rights, Ralph’s Wines Ltd guarantees all goods against faulty workmanship and materials for a period of 60 days from the date of delivery. 7.2) We take our customer satisfaction extremely serious and if you are dissatisfied with our performance in any way please contact us immediately and we will endeavour to deal with any enquiries fairly, confidentially and quickly.
